CENTURY 21 Collection (“CENTURY 21 Collection”, “we”, “our” or “us”) is an independently owned and operated franchised real estate agency, member of the CENTURY 21 network, with offices in Montréal and Brossard. We are committed to respecting your privacy and to being transparent about our personal information practices, in accordance with Quebec’s Act respecting the protection of personal information in the private sector, as amended by Law 25, and other applicable laws.
This Privacy Policy (the “Policy”) explains how we collect, use, disclose, retain and protect the personal information you provide when you visit century21collection.com (the “Site”), work with one of our brokers or otherwise interact with us (the “Services”).
By voluntarily providing your personal information, you consent to its collection, use and disclosure in accordance with this Policy. If you do not agree, please do not use the Site or provide us with your personal information. The French version of this Policy prevails.
1. Information we collect
“Personal information” means any information about an individual that allows that person to be identified, directly or indirectly.
Information you provide directly
- Contact and property inquiry forms: name, phone number, email, profile (buyer, seller or other), property or broker concerned, message and, if you opt in, newsletter subscription.
- Property evaluation form: first and last name, email, phone, address and type of property, and anything you add in your message.
- Career form: name, contact details, position sought, education, experience, résumé and any other information you choose to share.
- In the course of a brokerage contract or real estate transaction: information required for OACIQ contracts and forms, as well as identification documents required by law, including identity verification and anti-money-laundering requirements.
- Your property search criteria and buying, selling or renting preferences.
Information collected automatically
- When you browse the Site, our servers and hosting provider may log technical data: IP address, browser type and version, pages visited, date, time and duration of your visit.
- The Site may use cookies and similar technologies, as described under “Cookies and log data”.
We only collect the information necessary for the purposes stated at the time of collection.
2. Notice and consent
We obtain your consent to the purposes of collection, use and disclosure before or at the time of collection, unless otherwise permitted or required by law. Your consent is express, free, informed and given for specific purposes.
Subject to legal exceptions, you may withdraw your consent at any time on reasonable notice by writing to our Privacy Officer (see “Privacy Officer and contact”). Withdrawing consent may limit our ability to provide our Services.
3. How we use and disclose your information
We use your personal information to:
- Respond to your inquiries and connect you with the relevant or most appropriate broker;
- Provide our real estate brokerage services (listing, marketing, buying, selling, renting, evaluation) and perform contracts entered into with you;
- Meet our legal and regulatory obligations, including toward the OACIQ and under anti-money-laundering legislation;
- Assess broker and employee applications;
- Send you our newsletter, new listings and information about our Services, if you consented. You can unsubscribe at any time using the link in our emails or by writing to us;
- Maintain, secure and improve the Site and our Services.
We do not sell your personal information. We disclose it only as necessary:
- To CENTURY 21 Collection brokers handling your request or file;
- To CENTURY 21 Canada Limited Partnership, the network franchisor, when required to provide the Services;
- To other parties to a real estate transaction (cooperating broker, notary, lender, inspector, etc.), with your consent or under your mandate;
- To service providers that help us operate: Site and form hosting, email delivery, Centris (listing distribution), accounting, document storage and communication services. They are bound by confidentiality commitments and may only use your information to provide services to us;
- In the context of a business transaction (merger, sale or reorganization), where necessary and as permitted by law;
- Where required or permitted by law, including at the request of the OACIQ, a court or a public authority.
4. Cookies and log data
Cookies are small files stored by your browser. The Site only uses cookies and browser storage necessary for it to work (for example, remembering your language or search filters).
As of the date of this Policy, we do not use any cookies that identify, locate or profile you (targeted advertising, ad tracking). If we add any, they would be off by default and only enabled with your consent through a banner shown on your first visit, and this Policy would be updated.
You can set your browser (Google Chrome, Microsoft Edge, Mozilla Firefox, Apple Safari) to refuse or delete cookies in its privacy settings. Refusing some cookies may affect how the Site works.
5. Information security and hosting
We use reasonable technical, administrative and physical safeguards to protect your personal information: encrypted connection (HTTPS) across the Site, access limited to those who need it for their duties, and confidentiality commitments from our brokers, employees and providers.
No internet transmission or hosting system is 100% secure, so we cannot guarantee absolute security.
6. Confidentiality incidents
If a confidentiality incident occurs (unauthorized access, use or disclosure, or loss of information), we promptly take reasonable steps to reduce its consequences and prevent recurrence.
If the incident presents a risk of serious injury, we notify the Commission d’accès à l’information du Québec and the affected individuals. We keep a register of all confidentiality incidents, as required by law.
7. Data retention
We keep your personal information only as long as needed for the purposes for which it was collected, or as long as required by law. Real estate transaction files are kept for the period required by OACIQ regulations and our accounting and tax obligations.
Afterwards, information is securely destroyed or anonymized so it can no longer identify you. Anonymized information may be used for serious and legitimate purposes, such as market statistics.
8. Transfers outside Quebec
Some of our service providers (for example, Site and form hosting or email delivery) may store or process information outside Quebec, including elsewhere in Canada or in the United States.
Before disclosing personal information outside Quebec, we conduct a privacy impact assessment and ensure, through written agreements, that it receives adequate protection. Laws in those places may nonetheless differ from Quebec law.
9. Your rights: access, correction and withdrawal
Subject to legal exceptions, you may at any time:
- Ask whether we hold personal information about you and access it;
- Have inaccurate, incomplete or ambiguous information corrected;
- Obtain a copy of your computerized information in a structured, commonly used technological format (portability);
- Withdraw your consent or ask that dissemination of your information cease;
- Unsubscribe from our marketing communications.
Please let us know of any change to your information. To exercise your rights, write to our Privacy Officer; we may ask you to confirm your identity. We will respond in writing within 30 days. If we must refuse, in whole or in part, we will give you our reasons and your recourses. Access is free of charge; reasonable fees may apply for transcription, reproduction or transmission, and you will be told in advance.
10. Complaints
If you believe your personal information has not been handled in accordance with this Policy or the law, you may file a complaint with our Privacy Officer. We will handle it diligently and respond in writing.
If you are not satisfied with our response, you may contact the Commission d’accès à l’information du Québec (www.cai.gouv.qc.ca).
